Fifteen years after the Royal Commission into Aboriginal Deaths in Custody the rate of Indigenous imprisonment has increased; two main aims of this research is to determine whether there is any evidence of racial bias in the sentencing of Indigenous offenders and second to account for the high number of Indigenous offenders sentenced to terms of imprisonment; research revealed no evidence of racial bias on sentencing; argues that the higher rate of Indigenous imprisonment stems mainly from a higher rate of conviction for violent crime and a higher rate of re-offending, particularly following the imposition of sanctions intended as alternatives to full-time imprisonment; implications of the findings are discussed in detail
